Terms of Service
1. Acceptance of Terms
By accessing or using the Low Properties platform ("Platform") operated by Low Properties, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.
These Terms apply to all users including buyers, sellers, tenants, landlords, real estate agents, agency administrators, and Super Administrators.
We may update these Terms at any time. We will provide at least 14 days' notice for material changes. Continued use constitutes acceptance.
2. Platform Role & Disclaimer
Important: Platform Scope
Low Properties is a technology platform and SaaS service. We provide tools for property discovery, listing, communication, and analytics. We are NOT a real estate broker, agent, dealer, or any party to real estate transactions.
Specifically:
- We do not represent buyers, sellers, landlords, or tenants in any capacity.
- All real estate transactions, negotiations, and agreements occur directly between the parties involved (buyer/seller or tenant/landlord).
- We are not responsible for the accuracy of property listings, ownership claims, property valuations, or the outcome of any transaction.
- Users are solely responsible for conducting their own due diligence before entering any property transaction.
- All payments processed through this Platform are for SaaS subscriptions and platform features only — not for property purchases, rent deposits, or any real estate transaction value.
- Agents and sellers operating in regulated regions are individually responsible for maintaining valid RERA (Real Estate Regulation and Development Act) registrations and complying with all applicable state and central regulations.
Nothing in our Platform constitutes legal, financial, investment, or real estate advice.
3. Eligibility & Accounts
3.1 Age Requirement
You must be at least 18 years of age to create an account or use the Platform. By registering, you represent and warrant that you meet this requirement.
3.2 Accurate Information
You agree to provide truthful, current, and complete information during registration and to keep it updated. Providing false or misleading identity information may result in immediate account suspension.
3.3 Account Security
You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at support@lowproperties.com if you suspect unauthorised access to your account.
3.4 One Account Per Entity
Individuals and businesses may hold one account each. Creating multiple accounts to circumvent Platform limits or policies is prohibited.
4. User Roles & Obligations
4.1 Property Sellers & Landlords
- Must hold legal right or authority to list the property
- Must ensure listing information is accurate, complete, and not misleading
- Must hold valid RERA registration where required under applicable state law before listing for sale or rent
- Must not list the same property on fraudulent or duplicate accounts
4.2 Real Estate Agents
- Must hold a valid RERA agent registration in their operating state
- Must list properties only with written authority from the owner
- Are solely responsible for the accuracy of listings managed by them
- Must not engage in any practice that would constitute steering, discrimination, or misrepresentation
4.3 Buyers & Tenants
- Must conduct independent due diligence including title verification, encumbrance checks, and physical inspection before entering any transaction
- Acknowledge that Platform property data is user-generated and may not be verified
- Must not use the Platform to engage in speculative harassment of sellers or agents
4.4 All Users
- Must not use the Platform for illegal purposes
- Must not scrape, harvest, or systematically extract data from the Platform
- Must not attempt to circumvent security, authentication, or access controls
- Must not impersonate other users, agents, or staff
5. Subscriptions & Payments
5.1 Scope of Payments
All fees charged by Low Properties are for SaaS platform subscriptions and feature add-ons only. These are not related to the value of any property transaction. Low Properties does not charge commissions, brokerage fees, or any fee on property sales or rental transactions.
5.2 Payment Providers
Subscriptions are billed via third-party payment gateways: Stripe (international), Razorpay (India), and PhonePe (UPI/India). By making a payment, you agree to the respective provider's terms and privacy policy. Low Properties does not store card or bank account details.
5.3 Auto-Renewal
Subscriptions auto-renew at the end of each billing period. You will receive an email reminder at least 7 days before renewal. You may cancel at any time from your account settings.
5.4 Refund Policy
If you cancel within 14 days of your billing cycle start date and have not substantially used the paid features, you may request a prorated refund by emailing support@lowproperties.com. Refunds are not available for add-on purchases once the feature has been activated.
5.5 Tax
Applicable GST and other taxes will be added to subscription amounts based on your location. Tax invoices are issued by Low Properties.
6. Listings & Content Policy
You agree not to post content that:
- Is fraudulent, misleading, or intentionally deceptive
- References non-existent or unavailable properties (ghost listings)
- Discriminates on the basis of religion, race, caste, gender, disability, or other protected characteristics
- Contains illegal content, explicit material, or hate speech
- Violates the intellectual property rights of any third party (e.g., copying photos or descriptions from other platforms without permission)
- Purports to represent a RERA-registered project without valid registration
Low Properties reserves the right to remove any listing or content that violates these guidelines, with or without prior notice, at our sole discretion.
Agents and sellers operating verified accounts are held to a higher content standard and may be subject to additional review before listings are published.
7. AI Features Disclosure
The Platform includes AI-powered features including but not limited to: a conversational assistant, price suggestion tools, and property matching recommendations.
These AI features are informational and assistive in nature. They do not constitute legal advice, financial advice, investment advice, or any professional real estate counselling.
AI-generated outputs may contain inaccuracies. Users should independently verify any information provided by AI features before making decisions. By using these features, you acknowledge their limitations and agree that Low Properties is not liable for decisions made based on AI suggestions.
8. SMS & WhatsApp Consent
By creating an account and explicitly opting in during phone verification, you consent to receive the following communications via SMS and/or WhatsApp through our provider Twilio:
- One-time passwords (OTP) for login and two-factor authentication
- Critical security alerts (e.g., new device login attempt)
- Transactional platform notifications (e.g., inquiry received, document signed)
You will not receive unsolicited marketing messages via SMS or WhatsApp without your explicit opt-in. These transactional messages are sent by Low Properties using Twilio's messaging infrastructure. Standard message and data rates apply.
To opt out of non-critical notifications, update your preferences in Account Settings. OTP and security messages cannot be opted out as they are fundamental to account security.
9. Intellectual Property
All trademarks, logos, platform design, software, brand elements, and original content on the Platform are the property of Low Properties and are protected under applicable Indian and international intellectual property laws.
By posting content on the Platform (listings, photos, descriptions), you grant Low Properties a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content for the purpose of operating the Platform and marketing services. You retain ownership of your original content.
You may not reproduce, redistribute, scrape, or create derivative works from any Platform content without our prior written consent.
10. Liability & Disclaimers
10.1 No Transaction Warranty
Low Properties makes no representation or warranty about the legal status, title, condition, or value of any property listed on the Platform. All transactions are conducted at the parties' own risk.
10.2 Third-Party Provider Availability
We are not liable for outages or issues caused by third-party providers including Twilio (SMS/WhatsApp), Stripe, Razorpay, PhonePe, Mapbox, Vercel, or any other service used within our Platform.
10.3 Limitation of Liability
To the maximum extent permitted by applicable law, Low Properties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
Our total aggregate liability to you shall not exceed the amount you paid us in subscription fees in the 3 months preceding the event giving rise to the claim.
10.4 Platform Availability
We aim for high availability but do not guarantee uninterrupted Platform access. Scheduled maintenance or unforeseen outages may occur.
11. Account Termination
You may delete your account at any time from your account settings. Active subscriptions will remain valid until the end of the billing period.
Low Properties reserves the right to suspend or terminate accounts that:
- Violate these Terms of Service
- Engage in fraudulent, abusive, or illegal activity
- Are reported for serious and verified misconduct
- Have outstanding payment obligations
Where possible, we will provide advance notice before termination. In cases involving fraud or security threats, accounts may be suspended without prior notice.
12. Disputes & Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of India.
Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Hyderabad, Telangana, India.
To the extent court proceedings are necessary, the parties submit to the exclusive jurisdiction of courts in Hyderabad, Telangana, India.
